As long as a driver is using a hands-free cell phone, can dial or answer it with no more than a single touch, and does not have to leave the normal driving position to answer or initiate a call, the driver can use the cell phone while driving.
However, when the cognitive distraction of using a cell phone is a factor – as in heavy traffic, bad road conditions, and bad weather conditions – even though a driver CAN use his hands free cell phone, he should not.
14,000 times in 2013 drivers were cited for using a cell phone without meeting the requirements of the law governing cell phones, making these drivers more dangerous than drunk drivers.
